Collaboration and connection

International Clinical Educators (“ICE,” “ICE Learning Center,” “we,” “us,” etc.) was created to inspire clinical excellence in occupational therapy, physical therapy, and other allied health programs. We do that by providing innovative video streaming collections to faculty, students, and clinicians worldwide.

Doing so requires that we collect personal information from students and faculty at nearly 500 universities and learning institutions around the globe. We understand that this personal information needs to be collected, protected, shared, and used judiciously – with an eye toward transparency.

Because your personal information is valuable and sensitive, we want you to be confident that we are handling it with care and respect. We also want to give you the necessary tools and options to manage and protect that information. This Privacy Notice is part of our effort to achieve these goals.

As you interact with us, you will share your personal information in various ways. Sometimes we collect it directly from you on a voluntary basis. Other times, we use technology to automatically collect personal information. We also work with third parties with whom we share our users’ personal information.

This Notice applies to our Websites (https://www.icelearningcenter.com/ and https://faculty.icelearningcenter.com/) and any other sites or products that display these terms. It does not apply to any website, mobile app, service, or product that does not display or link to this Privacy Notice or that contains its own privacy notice. If you do not agree with our policies and practices, please do not use our services. By accessing our Websites or using our services, you agree to this Notice. 

How we use personal information

We know your personal information is important to you, so we want to be as transparent as possible while explaining how we use that information.

As mentioned above, schools and clinics register faculty, students, and/or clinicians by providing their names and email addresses to create profiles with associated user IDs and passwords. Collecting this information allows easier, quicker access to our Websites on subsequent visits. As users navigate through the Websites, their movements will be tracked and analyzed. Doing so allows us to make our videos more relevant, our products better, and their experiences easier. We also use personal information:

  • To communicate with customers about their accounts, such as when they want to change their passwords.

  • To respond to support requests.

  • To provide access to and maintain the security and integrity of the Websites.

  • To provide updates regarding the Websites and marketing information, such as when we develop and improve products and services, or request feedback through a survey, etc.

  • To comply with legal and regulatory requirements applicable to our business and internal policies for maintaining records.

  • To protect all parties in the event of disputes.

  • To comply with court orders and legal processes, and to enforce our Terms of Use and this Privacy Notice.

  • For any other legal, business, or marketing purposes that comply with the practices described in this Notice.

  • To send marketing communications, typically through email.

We sometimes take personal information and remove identifying details, then combine it into collective data that allow us to predict the behavior and interests of our user population. In this way, we can fine-tune our marketing campaigns and improve our video recommendations. In these cases, the subjects of the data remain anonymous.

How we collect personal information

We may collect personal information from you directly or indirectly. When schools or clinics want to create accounts for faculty, for example, they provide personal information of those faculty members to us. Once you have an account, you may provide additional personal information directly to us. Other times, personal information is collected automatically as you use our Websites. In some instances, third parties with whom we work (in addition to schools and clinics) provide personal information to us.

We collect personal information when your school or clinic provides it

When your school or clinic requests an account for faculty, it typically provides personal information that includes names, email addresses, job titles, and phone numbers for those faculty members.

We collect personal information when you provide it

For those accounts requiring registration, once you’ve been registered, you will create a username and password or PIN, information that on subsequent visits helps us confirm your identity and makes it easier to use our services. Along with those basic identifiers, we sometimes collect demographic information, such as gender, age, and image when they are submitted by faculty and/or students.

Depending upon the type of account a particular school or clinic has with us, in some cases students may stream our videos without an account. Faculty and students may provide personal information directly when they interact with ICE Learning Center online and offline, via social media, Web forms, by phone, in person at workshops or conferences – or even through regular old postal mail.

We collect personal information from third-party sources

In addition to receiving personal information from your school or clinic, we may collect personal information about you from third parties. We also may collect personal information from online social networks if you use them to connect with ICE, or if you take part in a forum, for example, on Facebook. We may collect personal information when you click “Share This” or “Like” buttons or otherwise use social media buttons or plug-ins.

We collect personal information using automated technologies

Sometimes personal information is collected by automated technologies and shared with us when Website visitors navigate through our videos and services online. We may track your browsing actions and log your IP address. We may collect data that identifies the device (phone, tablet, etc.) you are using to connect online with us. We also track keystrokes, browsing histories, videos watched, and purchase histories to make future visits to our Websites more relevant and efficient.

Other automated collection technologies – such as cookies, beacons, tags, and scripts – are used by us to analyze trends, administer the Websites, and track users’ movements around the Websites. We, and our third-party partners, also use these technologies to gather demographic information about our user base as individuals and as a whole. Read more about our use of cookies here.

We will not knowingly collect information from individuals under 16 years old

Our Websites, including the content we offer, are not intended for anyone younger than 16 years and we will never knowingly collect personal information from anyone younger than 16 years. However, personal information about children and teens is sometimes collected when parents or other adult caretakers provide us with consent for them to be included in videos during physical or occupational therapy. If we become aware that we have received personal information of anyone younger than 16, we will delete the information from our files.

Do-not-track requests

Some browsers offer a “Do Not Track” privacy preference. Generally, when a user turns on the Do Not Track Signal, their browser sends a message to websites requesting that the user not be tracked. Our Websites currently do not respond to “Do Not Track” signals.

When we share personal information

Once your personal information is collected, as detailed above, we may share it with third parties for various reasons. For example, we use Stripe to process purchases and payments and Constant Contact to help us with marketing campaigns and alerting users to content they may find useful. Google Analytics helps us track users’ movements around the Websites to help us keep them as relevant and useful as possible. Brightcove maintains access to our streaming content.

Faculty and students may opt out of us sharing their information with third parties by contacting us at inquire@icelearningcenter.com or (888) 665-6556. However, doing so will prevent faculty from accessing the ICE Faculty Zone as we need a name and email address to allow you access. It will also prevent faculty and students from accessing DocuLearn as we need a name and email address to allow you access. You also may decline to participate in marketing efforts by clicking “Unsubscribe” on any marketing email you receive, or by blocking our cookies on your internet browser. (For more information, see our cookie policy here.) Keep in mind that declining certain cookies may decrease the functionality of the Websites or disable some of their features.

Note that when we share your personal information with a third party, we require that third party to protect the information consistent with this Notice and limit its use of the information to performing the services they provide to us.

If you make a public post, other users may see it

If you make a post on a third-party social media site, such as on Facebook, or by identifying us in your social media feed by tagging us using a hashtag (#) or “at” (@), your personal information may be publicly available and is subject to the privacy policies of those third-party social media sites. As a reminder, this Notice describes how we will treat your personal information once it is in our possession.

We recommend you review the privacy policies of any third-party sites you visit to understand the data collection and use practices of that third party.

We may share feedback you provide to us

We want to hear how we’re doing. We encourage students, faculty, and clinicians to let us know which videos, products, and services they find useful. If they have suggestions for improving the Websites, videos, or teacher lesson plans, we want those as well. Please be aware that any feedback relating to our Websites or their content may be publicly shared.

Eventual successors may access information

In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, any user information owned or controlled by us may be among the assets transferred to third parties as successors in interest. As part of this type of transaction, we reserve the right to transfer or assign your personal information to third parties. Other than to the extent ordered by a bankruptcy or other court, or as otherwise agreed to by you, the use and disclosure of all transferred user information will be subject to this Notice.

We need to comply with legal requirements

We may disclose your information to government authorities or other third parties if any lawful circumstances arise, including when:

  • You have given us permission to share your information;

  • We are required to do so by law, or in response to a subpoena or court order;

  • We believe in our sole discretion that disclosure is reasonably necessary to protect against fraud, or to protect our property or other rights or those of other users of the Websites, third parties, or the public at large; or

  • We believe that you have misused the Websites by using them to attack or gain unauthorized access to a system or to engage in spamming or other conduct that violates applicable laws or our Terms of Use.

How we secure personal information

We have implemented current and commercially reasonable administrative, physical, and technology-based security measures to protect against loss, misuse, unauthorized access, and alteration of personal information in our systems. We shall take reasonable steps to ensure the reliability of any employee, agent, or contractor who may have access to the personal information, ensuring in each case that access is strictly limited to those individuals who need to know or access the relevant personal information, as strictly necessary for the purposes of the providing users access to ICE’s digital content and to comply with applicable laws. We ensure that any employee, contractor, corporation, organization, or vendor who has access to personal information in our systems is subject to legal or professional obligations to safeguard that personal information. The use of ICE Videos, the ICE Faculty Zone, and DocuLearn is intended for educational purposes only (e.g., with simulated patients, standardized patients, and/or patient videos). You are responsible for the protection of any sensitive patient health information.

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the Internet or form of electronic storage is 100 percent secure. Therefore, we cannot guarantee its absolute security. While we implement all reasonable steps to prevent data breaches, in the event of a breach we shall notify you without undue delay upon becoming aware of a data breach affecting personal information, providing you with sufficient information to allow you to meet any obligations to report or inform individuals affected by the data breach.

Questions or concerns about security or privacy protocols.

If you have received unwanted or unsolicited e-mail from us or purporting to be sent by us, please forward a copy of that e-mail with your comments to inquire@icelearningcenter.com for our review. If you feel that any of our privacy practices or security standards detailed in this Privacy Notice have been violated, you may contact us (see Contact Us at the end of this Notice for additional details).

Your Rights

We understand that you want to protect and control your personal information.  This section details how you may review, update, correct, or delete your information.

Viewing or updating your personal information 

For our users with accounts, you may update your name, contact information, email preferences, and school or clinic by contact us at inquire@icelearningcenter.com.

Deactivating your account

Faculty members may deactivate their accounts any time after they have been created for them. To deactivate an account, please send an email to inquire@icelearningcenter.com with “Deactivate Account” in the subject line. Upon receiving a deactivation request, we will deactivate the account and delete personal information when allowed or required by applicable law. Note that faculty cannot access the Faculty Zone without a name and e-mail address.

Opting out of promotional emails

If you do not wish to receive marketing e-mails from us, you may follow the unsubscribe process at the bottom of the e-mail you received or by emailing us at inquire@icelearningcenter.com. Please keep in mind that you still may receive transactional e-mails from us (such as e-mails related to the completion of your registration or purchases, correction of user data, password reset requests, reminder e-mails you have requested, and other similar communications) that may be necessary for us to make the Websites available to you or respond to your inquiries and support requests.

European Economic Area, Switzerland, or United Kingdom

Individuals from the European Union, including the United Kingdom and Switzerland, have certain rights associated with their personal information based on applicable law.

International Transfers

ICE Learning Center is headquartered in the United States. Your personal information will be transferred to, processed, and maintained on computer systems located in the United States.

The United States currently is not a country the European Union has deemed “adequate” under applicable data protection laws. ICE collects, transfers, and processes personal information under terms required by applicable law, including: when you provide your consent, to perform a contract with you (such as to deliver videos and teaching products), or to fulfill a compelling legitimate interest of ICE in a manner that does not outweigh your rights and freedoms. ICE may enter into data protection agreements or other legally approved mechanisms with its vendors to support compliance with applicable law.

Your data protection rights

In addition to any of the general rights granted to you under this Privacy Notice, European users have the following data protection rights:

  • You can request access to, correction of, updates to, or request deletion of your personal information.

  • You can object to the processing of your personal information, ask us to restrict the processing, or request portability of your personal information.

  • You have the right to opt out of marketing communications we send at any time. You can opt out by clicking on the “unsubscribe” or “opt out” link in any of the marketing emails we send you.

  • When we have collected and processed your personal information based upon your consent, you can withdraw your consent at any time. However, withdrawing your consent will not affect the lawfulness of any processing we conducted before your withdrawal, nor will it affect processing of your personal information where we have relied on other legal grounds for the processing.

  • You have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority.

To make a request, please contact us at inquire@icelearningcenter.com with “Personal Information Request” in the subject line. Provide full details relating to your request, including your contact information and any other details you believe are relevant. We are committed to responding to requests to exercise data protection rights in accordance with applicable data protection laws.

California Consumer Rights

The California Consumer Privacy Act (“CCPA”) provides specific rights to those who live in California. We have determined that we are not currently subject to CCPA. If, in future, we determine that CCPA applies to us, we will update these terms to ensure we reflect any additional rights granted. Those updates will be made available within this Privacy Notice, in accordance with the CCPA.

Identity verification requirement

The law requires us to verify that any request submitted was made by someone with the legal right to access the information. Therefore, before accessing or divulging any information pursuant to a data subject access request, we may request that you provide us with additional information so we can verify your identity and legal authority. 

To make a request, please contact us at inquire@icelearningcenter.com with “Personal Information Request” in the subject line and provide full details about your request, including your contact information and anything you believe is relevant. We will provide a response to an access request within the timeframes required by law. If we cannot substantively respond in a timely manner, we will notify you and provide the reason for the delay.

Under certain circumstances, we may not fulfill your request, such as when doing so would interfere with our regulatory or legal obligations, when we cannot verify your identity, if your request involves disproportionate cost or effort, or where the law allows us to retain that information. But we will respond to your request within a reasonable time, as required by law, and provide an explanation.

Updates

This Privacy Notice will be updated to reflect our personal information handling practices.  We reserve the right to amend this Notice at any time, for any reason, without additional notice to you, other than through posting the updated Privacy Notice on our Websites. We invite you to return to this page to ensure that you are informed of updates we make about how we collect, use, and protect customer information. You can see when this Privacy Notice was last updated by checking the “last updated” date displayed at the beginning of this Notice.
